A McLean County judge Monday set an August court date to hear a motion for fingerprint testing as a Bloomington man fights to clear his name in the murder of his father 20 years ago. 44 year old Donald Whalen is serving a 60 year prison sentence for the beating death of his father in 1991. Whalen is attempting to use DNA evidence to prove his innocence and claims he was asleep at the time of his father. The elder Whalen was found beaten to death at his Bloomington tavern. Previous DNA testing on blood and hair samples at the crime scene produced no surprises and were that of the victim. Whalen will be back in court August 2nd.
