Federal agency opens probe into Caterpillar

Investigation opened after company files complaint against CAT

PEORIA - A federal agency will open an investigation into whether Caterpillar committed patent infringement after a complaint by another company.

The U.S. International Trade Commission announced it will focus on products used to mill asphalt and concrete pavement to create a base for new road surfaces, according to a press release.

The investigation is based on a complaint filed by Wirtgen America, a Tennessee-based subsidiary of a German firm. Wirtgen America accuses Caterpillar of importing and selling certain road milling machine and other parts that the company believes infringes patents. 

The company filed the complaint in July, and included in the complaint are CAT subsidiaries in Switzerland, Italy and the U.S.

The USITC is a federal agency that investigates matters of trade. In a release, the agency makes clear it has not made any decisions on the merits of this case.

In a statement to WMBD, a Caterpillar representative says:

We are reviewing Wirtgen's claims and are committed to defending our products to the fullest extent. Because litigation is ongoing, we cannot comment any further.
