A Bloomington man, in his fight to clear his name in the murder of his father 20 years ago, will get another hearing in January regarding fingerprints. A judge Tuesday also ordered a status on DNA evidence in the case. 44 year old Donald Whalen is serving a 60 year prison sentence for the beating death of his father in 1991. Whalen is attempting to use DNA evidence to provide his innocence and claims he was asleep at the time of the murder of his father. The elder Whalen was found beaten to death at his Bloomington tavern. Previous DNA testing on blood and hair sampes at the crime scene produced no surprises and were that of the victim. Whalen will be back in court January 26th.
