A 12-person jury in Peoria County Circuit Court handed down a unanimous verdict Friday finding OSF Healthcare Saint Francis Medical Center guilty of medical malpractice.
According to Fogel Law Offices out of Chicago, in July of 2012, a 64-year-old resident of the Peoria area, underwent a laser extraction program to remove a pacemaker at OSFin Peoria. The patient later died in a hospital Cath Lab when the heart and blood vessels were perforated by the laser.
$2.5 million will go to the family for compensation for their loss.
OSF Saint Francis Medical Center released a statement Saturday
“We are disappointed in the outcome of the case as we believe we were able to provide the appropriate care. Our prayers are with the plaintiffs family.”
The jury returned the unanimous verdict in a one-hour deliberation. Plaintiff attorney Bob Fogel said that the verdict again shows that good and decent people will follow the law and hold companies and hospitals responsible for harm even when such entities provide thousands of good jobs in a community.
The Plaintiff was represented by attorney Robert Fogel of Chicago Illinois and James Lees of Charleston West Virginia.
