A hearing for a former Peoria city council candidate has been pushed back again.
Michael Sue, a Peoria a lawyer representing former city council candidate, Amr Elsamny, asked Judge James Mack to push his case against the Peoria Election Commission.
Sue says that allows more time for a witness to testify in court that her mail-in ballot was lost by the election commission during the early voting period.
Last week, Elsamny told WMBD that the alleged witness had not signed her ballot, and the election commission should have notified her, rather than tried to send it back through the mail. He also said he would take the case to the Supreme Court.
The state’s attorney’s office, representing the election commission, asked Judge Mack to dismiss the case saying early voting for the general election has already started and a change in the ballot now would require everybody to vote again.
The judge did allow the case to be pushed back. Elsamny is expected back in court on Wednesday.
